A suite of changes to the Planning and Environment Act 1987 (PE Act) came into operation on 22 July 2013.

The changes implement a number of government election commitments and are designed to improve the general operation of the Act, and in particular, to improve and simplify key planning processes.

  • An acquiring authority listed in the Scheme for a public acquisition overlay will be liable for compensation under Part 5 of the PE Act, regardless of whether a formal request for the overlay has been made to the planning authority. Acquiring authorities should check whether Schemes accurately list the authority which ought be liable for compensation.
  • VCAT's workload should decrease now that responsible authorities are able to amend permits issued by VCAT (unless VCAT directs otherwise) and VCAT no longer has additional powers over responsible authorities to extend expired permits.
