Current practice

In her 10 plus years with the VGSO, Janine has had a diverse practice which includes Supreme Court litigation, administrative law, merits and judicial review, disciplinary regulation and summary prosecutions. At various times, she has managed both the regulatory compliance and administrative law teams in addition to developing a litigation practice focussing on judicial review and challenges to government decision making.
 
In July 2016, Janine was appointed as a Sessional Member of the Victorian Civil and Administrative Tribunal. As a consequence of that appointment, she no longer practices in any matters involving the Tribunal and instead focusses on Superior Court litigation involving the State.
 
Janine is an experienced administrative lawyer who has acted for government agencies in a range of matters, often involving complex matters of statutory interpretation and strategy. She is able to offer expertise in government-based litigation including:
 
  • the conduct of Supreme Court litigation, particularly proceedings associated with challenges to government decision making which require conducted with short time frames; 
  • the management of Appeals brought in the Supreme Court; and
  • the conduct of an appeal from the Court of Appeal to the High Court of Australia.

Experience

During 2014, Janine played a key role in the management of litigation associated with East West Link. This involved conducting litigation in a time pressured and highly sensitive political environment.
 
Janine also has extensive experience in representing government in judicial review challenges to government decisions. During 2016, she was involved in the Lower our Tracks litigation, a judicial review challenge to decisions of the Minister for Planning in relation to level crossing removals.  She is currently involved in the Mirboo Ridge litigation involving a $2.65 billion claim against the State of Victoria in relation to its decision to ban fracking.
 
During 2013, Janine took a leave of absence from the VGSO and worked as a Senior Government Lawyer for the Government of Nauru, undertaking general advising and litigation work. She left this role as a result of the breakdown in the legal system in January 2014 and returned to the VGSO in May 2014.
 
Janine is originally from Western Australia where she worked in the State Solicitor's Office for 5 years, during which time she specialised in environmental law and general litigation.
 
Prior to her legal career, Janine spent eight years as a Town Planner.
