Current practice

Eleanor's practice focuses on human rights law, governance and integrity matters, administrative law, statutory interpretation, discrimination and equal opportunity law, and constitutional law matters.  Eleanor advises government bodies on their statutory and common law obligations, and acts on behalf of government in proceedings in both appellate courts, such as the Court of Appeal, and original jurisdictions, such as the Victorian Civil and Administrative Tribunal.

Eleanor has extensive expertise in the Charter of Human Rights and Responsibilities Act 2006, and can advise public bodies on their obligations under the Charter, draft Statements of Compatibility and Human Rights Certificates for bills and regulations, and act for public authorities in litigation involving the Charter.

Eleanor also has a deep understanding of the processes of Government, and is available to assist with specific legislative and policy projects.

Experience

Eleanor has worked in public law for over 13 years, working at VGSO, within various Government departments,  and at the Victorian Court of Appeal.

Her experience at VGSO has included:

  • Advising on the operation of the Charter in diverse fields such as native title law, prisoner management, public housing policy, post-sentence management of serious offenders, counter-terrorism legislation, and voluntary assisted dying laws
  • Delivering training to VPS staff on their responsibilities under the Charter and on preparing Statements of Compatibility
  • Representing the Attorney-General in a number of significant Charter cases before the Supreme Court and the Court of Appeal
  • Appearing before the Victorian Civil and Administrative Tribunal in Equal Opportunity matters
  • Advising a broad range of departments and agencies on the interpretation of legislation and the proper exercise of their statutory powers
  • Advising various clients on compliance with integrity requirements, privacy laws and information sharing schemes
  • Undertaking secondments to government agencies to undertake legal and policy work in areas including human rights, post-sentence management of serious offenders, government integrity and oversight, youth justice, disability, and police matters.

Eleanor also has an interest in books and publishing, and in 2012 she helped establish the Stella Prize, a major literary award celebrating Australian women’s writing and championing cultural change.
