In the final report of the Royal Commission into Misconduct in the Banking, Superannuation and Financial Services Industry, Commissioner Hayne recommended that Australia’s corporate regulator, the Australian Security and Investments Commission, adopt an enforcement approach that takes, as its starting point, the question of whether a court should determine the consequences of a regulatory contravention. In this panel discussion, Miriam Holmes, Assistant Victorian Government Solicitor, will explore enforcement strategies, with particular consideration of those looked at by the Commission, with regulators, Dr. Brendan Tatham (PrimeSafe) and Scott May (Victorian Commission for Gambling and Liquor Regulation) and legal professionals, Andrew Palmer QC and Tien Tran (VGSO).
